These Terms and Conditions ("Terms") govern your access to and use of the Move with Suz website, online member portal, video-on-demand library, live streaming classes, and in-person classes at our physical studio (together, the "Services"), operated by Move with Suz, Lourensford Estate, Somerset West, 7130, South Africa ("Move with Suz", "we", "us", "our").

By creating an account, submitting a membership application, booking a class, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

You must be at least 18 years old to create an account. If you are under 18, a parent or legal guardian must register on your behalf, accept these Terms, and take responsibility for your use of the Services.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at movewithsuz007@gmail.com if you suspect any unauthorised use of your account.

Physical exercise carries inherent risks. Participation in any class, programme, or activity offered by Move with Suz — whether in-person, live-streamed, or on-demand — involves a risk of injury, including but not limited to muscle strain, sprain, fracture, cardiovascular events, or other physical harm.

By using the Services, you confirm that:

• You are in good physical health and have no medical condition that would prevent you from safely participating in physical exercise, or you have consulted a qualified medical practitioner and obtained clearance to do so;
• You will inform your instructor of any injury, medical condition, pregnancy, or physical limitation before participating in a class;
• You will exercise at your own pace, use correct form, and stop immediately if you feel pain, dizziness, or discomfort;
• Nothing on the website, in a class, or in any communication from Move with Suz constitutes medical advice, and is not a substitute for professional medical consultation, diagnosis, or treatment.

Assumption of risk: You voluntarily participate in all classes and activities with full knowledge of the risks involved, and you assume all such risks of injury, illness, or death that may result.

Membership packages are subject to review and approval. Submitting a membership or package application does not guarantee access — class space at our physical studio is limited, and Suz will confirm availability before any package is activated or invoiced.

Once a package is approved and an invoice issued, payment is due via EFT using the reference provided on the invoice. Access is activated once payment has been confirmed. Prices are quoted in South African Rand (ZAR) and may change from time to time; changes will not affect a package already paid for.

Unless otherwise agreed in writing, fees already paid are non-refundable, including where a member chooses to cancel their membership before a fixed-term package or contract has ended.

Class bookings are made through the member portal and are subject to availability and capacity limits set for each class. A confirmed booking may be moved to a waitlist if a class reaches capacity, and waitlisted bookings are automatically confirmed if a spot becomes available.

Cancellation windows apply per class and are shown at the time of booking. Cancelling outside the permitted window, or failing to attend a booked class without cancelling, may result in the session being forfeited depending on your package type. Please contact Suz directly for cancellations outside the permitted window.

All video content, class recordings, images, logos, and other material made available through the Services are the property of Move with Suz or its licensors and are protected by copyright and other intellectual property laws. Your membership grants you a limited, non-transferable, non-exclusive licence to stream this content for your personal use only.

You may not download, copy, reproduce, distribute, publicly display, or create derivative works from any content without our prior written consent, and you may not share your account access with any other person.

You agree not to misuse the Services, including by attempting to gain unauthorised access to any account or system, uploading unlawful or harmful content, or using the Services in any way that could damage, disable, or impair them.

To the fullest extent permitted by law, Move with Suz, its instructors, staff, and affiliates shall not be liable for any injury, loss, or damage of any kind arising from or in connection with your participation in any class or use of the Services, including any indirect, incidental, or consequential loss, whether arising in contract, delict (tort), or otherwise — except where such liability cannot be excluded by law, including in the case of gross negligence.

You agree to indemnify and hold harmless Move with Suz, its instructors, staff, and affiliates against any claim, liability, damage, or expense (including reasonable legal costs) arising from your breach of these Terms or your participation in the Services, except to the extent caused by our gross negligence or wilful misconduct.

We collect and process personal information (such as your name, contact details, health information you choose to disclose, and payment records) solely to provide and administer the Services, in accordance with the Protection of Personal Information Act, 2013 (POPIA). We do not sell your personal information. For any questions about how your information is used, or to request access, correction, or deletion of your data, contact movewithsuz007@gmail.com.

We may suspend or terminate your access to the Services at our discretion, including for breach of these Terms, non-payment, or conduct that puts other members or staff at risk. You may cancel your membership at any time by contacting us directly.

We may update these Terms from time to time to reflect changes in our Services or for legal reasons. The "Last updated" date above will reflect the most recent revision. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Republic of South Africa, and any disputes arising from them will be subject to the jurisdiction of the South African courts.
